Service Description
Vermont Pest Control provides residential and commercial pest management services throughout the State of Vermont. Our services include, but are not limited to, inspection, identification, treatment, and monitoring of common pests such as rodents, insects, termites, carpenter ants, bed bugs, wasps, bees, ticks, mosquitoes, and wildlife. Treatment methods may include chemical applications, baiting systems, trapping, exclusion techniques, and integrated pest management approaches tailored to specific property conditions and pest pressures. Service schedules, treatment protocols, and pricing are determined based on the scope of infestation, property size, environmental factors, and seasonal pest activity. We may perform initial inspections, ongoing maintenance treatments, emergency services, and follow-up visits as agreed upon in your service agreement. All services are performed by licensed technicians in accordance with Vermont regulations and applicable federal guidelines governing pesticide use and wildlife handling.
No Guarantee or Warranty
Vermont Pest Control makes no express or implied guarantees regarding the complete elimination of pests from your property. Pest management outcomes depend on numerous variables beyond our reasonable control, including but not limited to: neighboring property conditions, structural integrity of buildings, weather patterns, adherence to preparation instructions, introduction of new pest sources, and natural pest reproductive cycles. We do not warrant that treated areas will remain pest-free for any specific duration. Any reduction in pest activity does not constitute a guarantee of permanent eradication. Our service warranties, if offered in your specific service agreement, are limited to the terms explicitly stated in that agreement and do not extend beyond scheduled retreatment obligations. We expressly disclaim all warranties of merchantability, fitness for a particular purpose, and non-infringement with respect to our services.
User Responsibilities
You agree to provide accurate information about your property, pest issues, health conditions, and environmental sensitivities that may affect service delivery. Prior to scheduled treatments, you must prepare the premises as instructed, which may include removing pets, covering food preparation surfaces, securing valuables, and ensuring access to treatment areas. You are responsible for maintaining structural integrity, sealing entry points we identify, and following all post-treatment instructions provided by our technicians. Failure to comply with preparation or follow-up requirements may void any service commitments and may result in additional charges. You must inform us of children, elderly residents, pregnant individuals, pets, or individuals with chemical sensitivities, respiratory conditions, or compromised immune systems present on the property. You warrant that you have legal authority to authorize pest control services for the property in question.
Limitation of Liability
To the maximum extent permitted by applicable law, Vermont Pest Control and its officers, employees, agents, and contractors shall not be liable for any indirect, incidental, consequential, special, or punitive damages arising from or relating to our services, including but not limited to property damage, personal injury, loss of use, lost profits, or emotional distress, regardless of whether such damages were foreseeable or whether we were advised of the possibility of such damages. Our total cumulative liability for any claims arising from our services shall not exceed the total amount you paid for the specific service giving rise to the claim during the twelve-month period preceding the event. This limitation applies regardless of the theory of liability, whether contract, tort, negligence, strict liability, or otherwise. You acknowledge that pest control involves inherent risks and that our pricing reflects this allocation of risk.
Intellectual Property
All content, materials, trademarks, service marks, trade names, logos, photographs, videos, written materials, treatment protocols, and proprietary methodologies associated with Vermont Pest Control are our exclusive property or licensed to us. You may not reproduce, distribute, modify, create derivative works from, publicly display, or exploit any of our intellectual property without our prior written consent. Any feedback, suggestions, or ideas you provide regarding our services may be used by us without compensation or attribution. Our service reports, inspection findings, and treatment documentation are generated for our business purposes and remain our property, though copies may be provided to you for your records upon request.
Governing Law
These Terms of Service and any disputes arising from or relating to our services shall be governed by and construed in accordance with the laws of the State of Vermont, without regard to its conflict of law principles. Any legal action, suit, or proceeding arising out of or related to these terms or our services shall be instituted exclusively in the state or federal courts located in Chittenden County, Vermont. You irrevocably submit to the jurisdiction of such courts and waive any objection to venue laid therein. If any provision of these terms is held invalid or unenforceable under Vermont law, the remaining provisions shall continue in full force and effect.
Changes to Terms
We reserve the right to modify or update these Terms of Service at any time, with or without prior notice. Material changes will be communicated through our website, email notification, or upon your next service appointment. Your continued use of our services after any changes constitutes your acceptance of the revised terms. We encourage you to review these terms periodically. The "Last updated" date at the top of this document indicates when the most recent revisions were made. If you do not agree to the modified terms, you must discontinue using our services and notify us to terminate any active service agreements.
